The DOT drug test checks for five classes of drugs: marijuana, cocaine, amphetamines (including methamphetamine and MDMA), opioids (including heroin, oxycodone and hydrocodone) and phencyclidine (PCP).

Owner operator drug testing program: the setup checklist

Owner operator drug testing requirements come down to six things, because you are the employer and the driver. One person carries both sets of duties. The usual way to handle the employer side is a consortium.

    Join a random testing pool

    A pool of one cannot be random. A consortium places you in a pool with other drivers.

  2. 2.

    Take a pre-employment drug test

    With a verified negative result before your first load.

  3. 3.

    Register in the Clearinghouse

    Register as an employer and designate your consortium as your C/TPA, so it can handle reporting.

  4. 4.

    Run the queries

    A pre-employment full query on yourself and the annual query, through the Clearinghouse.

  5. 5.

    Have a written policy

    A drug and alcohol policy and the educational materials Part 382 requires. Consortiums usually provide templates.

  6. 6.

    Keep the records

    Results, selection history and enrollment, ready for a safety audit or investigation.

Skipping these is a violation of Part 382. It can lead to penalties and to problems at your new entrant safety audit, and brokers may ask to see your enrollment certificate before they load you.

Do truck drivers get drug tested? Drug testing for trucking companies

Every CDL truck driver working for a motor carrier is in a DOT testing program: a truck driver drug test before the first trip, random tests through the year, and the other tests when the rules call for them. Trucking companies with employed CDL drivers run the program as the employer, often through a consortium or third-party administrator.

A trucking drug test under DOT rules is a urine drug test and, for alcohol, a breath or saliva test, collected at certified sites under 49 CFR Part 40. Fleets also query each new CDL driver in the Clearinghouse before they drive and query current drivers at least once a year.

So do non CDL drivers get drug tested? Not by DOT. Only by company policy or a customer's requirement.

Do box truck drivers get drug tested?

Usually not under DOT rules. Most 26 ft box trucks are built at or under 26,000 lb GVWR, so they need no CDL, and DOT drug and alcohol testing applies only to CDL drivers. Check the weight rating on the driver's door sticker, not the box length.

That changes the moment the truck needs a CDL: a straight truck rated over 26,000 lb, a box truck pulling a heavy trailer, or any truck hauling placarded hazmat. Then the full program applies, including for an owner operator.

Non-CDL drivers can still be tested outside the DOT program. A shipper or broker can require it, and a company can set its own non-DOT policy. Those tests follow the company's rules, not Part 382.

Drug testing questions

Q-01Do owner-operators need random drug testing?

Yes, if they drive a truck that needs a CDL. An owner operator is both employer and driver, so the random testing rules apply, and a one-person company has to be in a larger pool, usually through a consortium. Owner operators of non-CDL trucks are outside the DOT testing program.

Q-02Do box truck drivers get drug tested?

Under DOT rules, only if the box truck needs a CDL: over 26,000 lb GVWR or hauling placarded hazmat. Most 26 ft box trucks are rated at or under 26,000 lb, so their drivers are not in the DOT program. A shipper, broker or company policy can still require non-DOT tests.
